Welcome to Perfect Pancake™. By accessing our website or purchasing from us, you agree to be bound by these Terms of Service. Please read them carefully before using our site or placing an order.
1. General Conditions
We reserve the right to refuse service to anyone for any reason at any time.
We may modify, suspend, or discontinue products, services, pricing, or availability at any time without prior notice. Perfect Pancake™ may occasionally release products in limited quantities, testing phases, or sample programs.
We are not liable to you or any third party for any modification, price change, suspension, or discontinuation of products or services.
2. Eligibility & Age Requirement
You must be at least 18 years old, or the age of majority in your state or jurisdiction (whichever is older), to use our Services or place an order. By using our Services, you represent that you meet this age requirement.
Our Services are not directed at children under the age of 13, and we do not knowingly collect personal information from children.
3. Product Use
Perfect Pancake™ Cast Net Conditioner is intended for external gear care use only.
Always follow the directions on the product label and on our website. If you are unsure how the product will interact with your specific net or setup, test on a small area first and use your own judgment.
This product is designed for cast nets and similar fishing gear. It is not intended for clothing, household fabrics, washing machines, or other unrelated uses.
We are not responsible for damage resulting from misuse, failure to follow directions, improper application, or use on materials not intended for this product.
4. Pricing, Promotions & Availability
All prices are listed in U.S. dollars and may change at any time without notice.
From time to time we may release products through testing programs, limited releases, sample distributions, or early access opportunities.
We make every effort to accurately display product information, images, and pricing. However, we do not guarantee that descriptions, images, or pricing are error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to modify or cancel orders if necessary, including after an order has been submitted.
5. Shipping & Delivery
At this time, Perfect Pancake™ ships within the United States only.
Shipping options, rates, and estimated delivery times are displayed at checkout and may change from time to time.
Once an order has been handed off to the carrier, shipping timelines and final delivery are managed by that carrier. We are not responsible for delays, carrier errors, or issues outside our control once a package is in transit.
6. Billing & Account Information
You agree to provide current, complete, and accurate purchase and contact information for all orders placed through our store.
This includes your name, billing address, shipping address, email address, and payment details. We may contact you using the information you provide if we need additional information to process or verify an order.
7. Third-Party Services & Social Media
Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell products to you. We use Klaviyo for email communications and connect with our customers through Meta Platforms (Facebook and Instagram) for social media engagement, customer support, advertising, and giveaways.
Your use of Shopify, Klaviyo, Meta, and any other third-party services is subject to their own terms, conditions, and privacy policies.
When you engage with us on social media (e.g., commenting on posts, entering giveaways, sending direct messages), you agree that those interactions are governed by the relevant platform’s terms in addition to these Terms of Service.
We are not responsible for outages, errors, security incidents, or service interruptions caused by third-party platforms or providers.
8. Intellectual Property
All content on this website — including the Perfect Pancake™ name, logos, product names, text, images, graphics, and designs — is the property of Perfect Pancake™ unless otherwise noted.
You may not copy, reproduce, distribute, modify, or use our content for commercial purposes without our prior written permission.
9. User Conduct
When interacting with our website, products, social media presence, or sample programs, you agree not to:
- Submit false or misleading information
- Engage in abusive, harassing, or deceptive behavior toward Perfect Pancake™ or other community members
- Misuse our products or attempt to misrepresent product results
- Violate any applicable law or third-party right
- Attempt to interfere with the operation of our website or services
We reserve the right to refuse service, remove comments, or block users from our social media presence at our sole discretion.
10. Returns, Refunds & Replacements
Because Perfect Pancake™ is a liquid net-care product, returns are limited and are subject to the conditions outlined in our Shipping & Returns Policy.
In general, return requests must be made for unopened and unused bottles within 30 days of delivery.
Items distributed as free samples, promotional items, or testing-phase releases are not eligible for return.
11. Limitation of Liability
To the fullest extent permitted by law, Perfect Pancake™ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, our products or website.
Our total liability for any claim related to a product shall not exceed the purchase price of that product.
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Perfect Pancake™, its owners, partners, and affiliates from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms of Service or your misuse of our products or services.
13. Dispute Resolution
In the event of a dispute, the parties agree to first attempt to resolve the matter informally by contacting us at hello@throwaperfectpancake.com.
If informal resolution is not successful, any claim or dispute arising out of or relating to these Terms of Service or our products shall be resolved through binding individual arbitration administered by a recognized arbitration provider, conducted in the State of Florida, in accordance with applicable arbitration rules.
You and Perfect Pancake™ each agree to waive the right to participate in any class action or representative proceeding. This arbitration provision does not apply to claims that may be brought in small claims court.
14. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
15. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies posted on our website, constitute the entire agreement between you and Perfect Pancake™ regarding the use of our Services and supersede any prior agreements.
17. Changes to These Terms
We may update or revise these Terms of Service from time to time. Any changes will be posted on this page with an updated “Last updated” date.
Continued use of the site constitutes acceptance of the revised Terms.
